The following is a binding contract to which the customer agrees implicitly by using any of the services provided by Rapidware Publishing Inc. including is subsidiary, Digitize-it. In the following contract all mention of Digitize-it refers to Digitize-it as well as its parent company – Rapidware Publishing Inc. 

Digitize-it does not make any warranties expressive or implied as to the quality, satisfaction, including the warranties of merchantability and fitness for a 
particular purpose, or assumes any legal liability or responsibility for the accuracy, completeness, or usefulness of any information, apparatus, product, service, or process disclosed. 

Digitize-it does not assume any responsibility for any loss, physical, or personal damage, or any other type of damage that may in any way result from the use of its products or services. The customer submits material to Digitize-it with full understanding that Digitize-it is not responsible for any damages to the material itself, or any damage resulting from the use of the material and its digital or other reproductions or alterations produced by Digitize-it. 

Digitize-it accepts only legal material for reproduction and will not in any case reproduce copyrighted material without permission from the owner of the copyright to the extent of the knowledge of the employees of Digitize-it. The customer accepts all responsibility for violating any copyright laws in submitting any material for reproduction or other services without notifying Digitize-it of the copyright nature of such material. The customer agrees not to hold Digitize-it responsible for any violation of national and international copyright laws without its knowledge. 

Digitize-it will not accept any material of explicit sexual nature, or other material intended for mature viewers for reproduction, and takes no responsibility for such material. Digitize-it may choose to return the material (for a shipping and handling charge) or destroy such material at its discretion. Digitize-it reserves the right to decide which material falls under these categories. 

Digitize-it assumes no responsibility whatsoever for any possible loss or damage incurred in shipping the material from or to the customer. 

The customer agrees that in the event of any dispute, such a dispute will be settled in the Court of the State of New York.
